TERMS OF SERVICE
1. INTRODUCTION
Welcome to Root, a service provided by Language League ("Parent Company") through its SaaS app Root ("we", "us", "our") located in Valencia, Spain. This website, rootvocab.com (the "Site"), provides a Software as a Service (SaaS) vocabulary tracker (the "Service" or “Services”) for users to practice vocabulary when learning a new language.
This Agreement is entered into by us and the entity or person agreeing to these terms (the "Customer," “You” or “Your”) and govern the Customer's access to and use of the Services.
2. ACCEPTANCE OF TERMS
By accessing and using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not access or use the Service.
3. ELIGIBILITY
Our Service is available worldwide without geographical restrictions. You must be at least 13 years old and meet the minimum age of digital consent in Your country. If You are old enough to access the Services in Your country, but not old enough to have authority to consent to our terms, Your parent or guardian must agree to our terms on Your behalf.
4. ACCOUNT REGISTRATION AND TERMINATION
To access our Service, users must create an account on our Site. Users are responsible for maintaining the security of their accounts and must report any unauthorized usage to us. Users can delete their accounts at any time through their profile page.
5. USER OBLIGATIONS AND CONDUCT
Users must not abuse our AI to generate results outside of what is intended for each use case. AI-generated content in the Service may not be used for commercial or non-commercial purposes outside the Service unless given explicit permission from us. Any abuse may result in termination of the account.
6. PRICING AND PAYMENT TERMS
We may invoice You for Your use of the Services through a third party payment service provider. The third party service provider’s terms of service shall govern and supersede this Agreement in case of conflict.
You are free to cancel Your plan at any time. Given the existance of a free trial plan, no refunds not prorrated refunds will be issued under any circumstance. We also reserve the right to terminate Your access to the Service for any reason, including for violation of the Community Guidelines or other inappropriate use of the Service. Any violation of Community Guidelines is a breach of this Agreement. You will not be refunded for the current subscription period, but You will not be charged after the current subscription period has ended.
7. INTELLECTUAL PROPERTY RIGHTS
Any AI-generated content in the Service may only be used inside the Service and by the user who generated it, and may not be used outside for any purpose that involves sharing it with other people in real life such as teaching, practicing in groups or printing without our explicit consent among other actions of the same nature. An exception to this rule is live-streaming in platforms such as Twitch or YouTube. Accounts that are found violating this rule may be terminated without a warning. We do not claim ownership of the AI-generated content, and users are responsible for any and all AI-generated content in the Service. Generating content that is deemed unsafe, NSFW or illegal will cause in termination of the account, regardless of whether it was intentional or not.
8. PRIVACY POLICY
We collect cookies through Google Analytics and use operative cookies to reference users between the browser and the server. For more information, please refer to our Privacy Policy.
9. LIMITATION OF LIABILITY AND WARRANTY
Limitation of liability:
a) We shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our service.
b) We do not guarantee the accuracy, reliability, or completeness of the generated AI content and shall not be responsible for any errors or omissions.
c) Users are solely responsible for the content they generate and the consequences of using such content.
Warranty Disclaimer:
a) Our service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the performance, availability, or suitability of our service for any particular purpose.
b) We do not warrant that the service will be uninterrupted, error-free, or secure.
c) We do not endorse or guarantee the legality, accuracy, or reliability of the generated AI content.
User Responsibility:
a) Users are responsible for complying with all applicable laws, regulations, and guidelines when using our service.
b) Users are prohibited from using our service to generate or distribute any content that is illegal, harmful, offensive, or infringes upon the rights of others.
Indemnification:
a) Users agree to indemnify and hold our company and its affiliates, employees, and partners harmless from any claims, damages, losses, or expenses (including legal fees) arising out of or related to their use of our service or any violation of these terms.
10. TERMINATION OF SERVICE
We reserve the right to terminate access to our Service for any abuse, including but not limited to AI prompt hijacking, AI prompt hijacking attempts or illegal, harmful or offensive AI usage. Upon termination, all data and information from the account will be deleted.
11. CHANGES TO TERMS OF SERVICE
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
12. GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Spain. You agree that any legal action or proceeding between us for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Valencia, Spain.
